Nach Ernst Blochs Prinzip Hoffnung und Hans Jonas' Prinzip Verantwortung ist im Übergang vom zweiten zum dritten Jahrtausend ein drittes Prinzip ins Zentrum der philosophischen Debatte gerückt: jenes der Menschenwürde. In Wirklichkeit handelt es sich eher um eine Wiederentdeckung als um etwas wirklich Neues, denn schon in der Nachkriegszeit spielte das Thema eine große Rolle. Heute jedoch erleben wir zweifellos ein noch größeres Revival. Diese Arbeit zeigt kurz den philosophischen Weg auf, der zur Herausbildung der Idee der Menschenwürde führte. Sodann wird versucht, deren wichtigste Rezeptionen im juristischen Bereich darzustellen; dabei werden einige exemplarische Rechtsdokumente in ihren Kernaussagen analysiert. Schließlich soll die Entwicklung der rechtsphilosophischen Debatte bis hin zu den vom medizinisch-biologischen Fortschritt angestoßenen Diskussionen erörtert werden. Eine Darstellung der Menschenwürde in der Schweizer Bundesverfassung findet sich im Anhang der Arbeit.Following Ernst Bloch's principle of hope and Hans Jonas's principle of responsibility, a third principle has, in the transition to the third millennium, moved to the centre of philosophical debate: that of human dignity. This study traces the emergence of the concept and attempts to illustrate the most significant aspects of its reception in the field of law. In addition, the work also discusses the course of legal-philosophical debates up to and including those elicited by bio-medical developments.
